Welcome to EmphoeniX. These Terms of Use (“Terms”) govern your access to and use of our website, mobile application, and meal delivery services (collectively, the “Services”). By accessing or using our Services, you agree to abide by these Terms.

1. Use of Services

  • Service Scope: Our Services enable you to order and receive freshly prepared meals at your chosen delivery location.

  • Accurate Information: You agree to provide complete and accurate information when placing orders.

  • Fresh & Timely: All meals are freshly prepared and delivered within your selected time slot.

  • Right to Refuse: We reserve the right to cancel orders or deny access to Services in cases of fraudulent, abusive, or illegal activity.

2. Order Placement and Payment

  • Advance Booking: Orders must be placed in advance for next-day lunch deliveries.

  • Payment Process: Full payment is required at the time of order using accepted payment methods.

  • Cancellation Policy: Orders once confirmed cannot be modified or cancelled, except as outlined in our Cancellation Policy.

  • Rejections & Refunds: We reserve the right to cancel orders due to unavailability, pricing errors, or operational challenges. Applicable refunds will be processed promptly.

3. Delivery Protocol

  • Sustainable Delivery: All deliveries are managed in-house using electric vehicles for a reliable and eco-friendly experience.

  • Time Slots:
    Lunch:
    • 12:00 PM – 1:00 PM
    • 12:30 PM – 1:30 PM
    • 1:00 PM – 2:00 PM

    Dinner:
    • 6:00 PM – 7:00 PM
    • 6:30 PM – 7:30 PM
    • 7:00 PM – 8:00 PM

  • Delays: While we strive to meet delivery windows, delays may occur due to traffic or weather.

  • Safe Drop Instructions: If you're unavailable, we may leave the order in a designated safe spot per your instructions.

4. Refund & Cancellation Policy

  • Cancellation Window: You may cancel your order up to 5 hours before the selected delivery time for a full refund.

  • Unsuccessful Deliveries: If a delivery fails due to reasons beyond your control, a full refund will be processed within 2 business days.

  • Exclusions: Refunds will not be issued for failed deliveries due to incorrect addresses or unavailability of the recipient.

5. User Responsibilities

  • Account Security: You are responsible for safeguarding your login credentials.

  • Service Integrity: You agree not to misuse the platform, engage in fraudulent activity, or attempt to gain unauthorized access.

  • No Resale: Meals ordered via EmphoeniX may not be resold or redistributed without prior written approval.

6. Data Privacy and Security

  • Privacy Commitment: Your data is collected and used in accordance with our Privacy Policy.

  • Secure Payments: All payment transactions are processed securely; sensitive payment data is not stored.

  • Limitations: While we employ robust security practices, no online system can guarantee absolute protection.

7. Modifications and Termination

  • Terms Updates: These Terms may be updated periodically. Continued use of our Services constitutes acceptance of any changes.

  • Access Termination: We may suspend or terminate access for violations of these Terms or misuse of the platform.

8. Limitation of Liability

  • Allergy Disclaimer: We cannot guarantee meals are free from allergens. Customers are advised to review ingredients and consume responsibly.

  • Service Disruptions: We are not liable for indirect, incidental, or consequential damages arising from delays or disruptions.

9. Age Restrictions

Our Services are intended for individuals aged 18 years and older. If we identify that a minor has registered or used our Services, we will take steps to restrict access and remove related data.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Government of India. Disputes, if any, shall be resolved through arbitration or applicable legal procedures in accordance with Indian law.
